Ministry-level scientific workshop “Mechanism to attract legal experts who are Vietnamese residing abroad to contribute to legal and judicial activities” organized by the Ministry of Justice with the sponsorship of Lawrel Law Company Limited at Palace Saigon Hotel on July 17, 2025

At the Workshop – Ms. Pham Thi Hong Nhung – Lawrel’s member lawyer presented a paper on “A MODEL TO ATTRACT OVERSEAS LEGAL INTELLECTUALS – INTERNATIONAL EXPERIENCES AND RECOMMENDATIONS FOR VIETNAM”. The paper demonstrates the policy of attracting overseas Vietnamese human resources, especially intellectuals, which was set out early by the Party and State of Vietnam, and has been consistently demonstrated through many important documents. In 2004, Resolution No. 36-NQ/TW of the Politburo on work with overseas Vietnamese for the first time affirmed the role of the overseas Vietnamese community as “an inseparable part of the Vietnamese ethnic community” and emphasized the task of attracting intellectuals to serve the development of the country. Next, Directive No. 45-CT/TW dated May 19, 2015 continued to emphasize the need to “create favorable conditions for overseas Vietnamese to contribute their intelligence” to the fields of science and technology, education and training, and policy reform. Most recently, Conclusion No. 12-KL/TW dated August 12, 2021 of the Politburo on overseas Vietnamese affairs in the new situation has set forth the requirement for innovation in thinking in approaching, attracting, and effectively promoting the potential and resources of the overseas Vietnamese community. This document identifies the connection of high-quality resources from outside as an essential component of the national development strategy. These orientations have created a political and legal basis for activities connecting overseas Vietnamese experts in many fields, including law, through the form of scientific forums, thematic seminars, short-term training cooperation, or giving opinions on law making. The implementation of these policies has achieved some positive results. Overseas Vietnamese intellectuals, including many legal experts, have been recognized as an important component of the Vietnamese community, a valuable resource that needs to be respected, listened to and facilitated to develop. Forms of connecting overseas intellectuals have been expanded and diversified. The overseas Vietnamese community has gathered into organizations to strengthen connections, typically the Union of Vietnamese Associations in Japan, the Association of Vietnamese Intellectuals in Japan, the Association of Overseas Vietnamese Businessmen (OV Business Associations)… These networks act as a knowledge bridge between overseas Vietnamese and domestic agencies, especially in areas such as public policy research, technology transfer, legal reform and training of high-quality human resources. At the same time, Project 165 has made an important contribution to improving the quality of the team of leaders and managers through organizing thousands of training and fostering sessions abroad with the state budget. The project helps the team of officials access modern management thinking, improve foreign language skills, international integration knowledge and create a source of strategic staff for the central and local levels.

Through comparing policies to attract legal intellectual human resources abroad, the article shows that establishing appropriate remuneration mechanisms, a network of overseas experts and training and research cooperation programs can create a solid foundation to connect the community of Vietnamese legal experts with the domestic legal system. The proposals in the article aim to build a favorable legal corridor and professional environment, thereby contributing to the development of a modern and integrated judiciary in Vietnam.
