Recently, Mr. Nguyen Tan Hoang Hai, LL.M. – a Legal Counsel at Lawrel – participated in and contributed a presentation titled “Rights to Adjoining Immovable Property After 10 Years of the 2015 Civil Code’s Application.” The presentation was part of the scientific conference, “10 Years of Applying the 2015 Civil Code on Ownership and Other Property Rights,” organized by the Ho Chi Minh City University of Law.
The right to adjoining immovable property is a crucial legal institution that ensures property owners can exercise their usage rights reasonably through the limited exploitation of an adjacent property belonging to another party. It serves as a legal tool to balance the interests of owners of adjoining properties. After 10 years since its promulgation and over 8 years of official enforcement, the provisions on the rights to adjoining immovable property in the 2015 Civil Code have had a significant impact on practical application and judicial proceedings.
In his presentation, Mr. Hai analyzed the current legal provisions related to these rights. Through the examination of real-world cases, he evaluated the advancements and the remaining obstacles more than eight years after the 2015 Civil Code took effect. Based on this analysis, he proposed solutions to improve the law and enhance its enforcement efficiency in the future.
