CONFERENCE “ALTERNATIVE DISPUTE RESOLUTION METHODS IN THE DEVELOPMENT OF DIGITAL TECHNOLOGY” ON MARCH 22, 2023

Recently, the Faculty of International Law at the Ho Chi Minh City University of Law, in collaboration with Nishimura & Asahi Law Firm and the Southern Trade Arbitration Centre (STAC), successfully organized a scientific conference on the topic: “Alternative Dispute Resolution Methods in the Development of Digital Technology.” The conference featured presentations from various experts and legal practitioners.

At the conference, Ms. Ngo Nguyen Thao Vy, LL.M., a legal counsel at Lawrel LLC Law Firm, delivered a presentation titled: “Personal Data Protection in the Application of AI to Online Alternative Dispute Resolution: The Complexities of the Interplay between Arbitration Law, Data Protection Law, and Data Economics.”

The application of artificial intelligence not only has the potential to accelerate the online dispute resolution process but also encourages parties to reach swift solutions by improving predictability and mitigating risks. As AI models rely on information extracted from input data, dispute resolution services become more effective thanks to publicly available or accessible decisions and awards. However, concerns have emerged regarding AI’s impact on decision-making processes, transparency, and the control over dispute resolution data and algorithms, as well as potential risks to personal data protection, especially in arbitration proceedings. Therefore, this presentation explores the challenges of balancing the need for efficient, AI-assisted online dispute resolution with the requirement to protect personal data, from the perspectives of arbitration law, personal data protection law, and data economics.
