From October 18 to 20, 2023, the 10th International Society of Construction Law Conference was held in Istanbul, Turkey, hosted by SCL Turkey (the Turkish Society of Construction Law). The conference gathered many leading experts in the legal and construction fields worldwide to discuss trends, regulations, and legal solutions in the construction industry.
At the conference, Dr. Nguyen Thi Hoa – a Senior Legal Counsel at Lawrel LLC Law Firm – delivered a presentation on the topic:
“Evolution Of The Laws And Regulations On Construction In Vietnam Toward Harmonization With International Practices.”
The presentation delved into three important areas:
- International Standard Contracts and Vietnamese Law Dr. Nguyen Thi Hoa analyzed the legal consequences of Vietnamese competent state authorities recognizing and using international standard contract forms, particularly those from the International Federation of Consulting Engineers (FIDIC).
- Alternative Dispute Resolution (ADR) in the Construction Industry The presentation evaluated Vietnam’s legal framework for promoting Alternative Dispute Resolution (ADR), especially the role of the Dispute Adjudication Board (DAB) and multi-tiered dispute resolution clauses in construction. This analysis helped clarify the effectiveness, challenges, and legal basis for developing ADR methods in Vietnam.
- Application of BIM Technology in Construction and the Related Legal Framework In light of the significant impact of the Fourth Industrial Revolution, the presentation also addressed new directives from the Vietnamese government regarding the mandatory integration of Building Information Modeling (BIM) technology into construction practices. These regulations not only enhance project management efficiency but also pose legal challenges that need to be addressed and refined.
Dr. Nguyen Thi Hoa’s presentation attracted considerable interest from the attending experts, sparking lively discussions on legal policies and their practical application in Vietnam’s construction industry.
